Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Self & Match platform ("Service"), operated by Data Makes the Difference, LLC ("Company," "we," "us," or "our"), located at selfandmatchapp.com. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

Self & Match is the exclusive digital platform for the Self & Match System, a behavioral self-monitoring program developed in partnership with its creators, Jamie Salter and Katie Croce. The Service enables educators, therapists, and authorized users ("Users") to create self-monitoring forms, track learner progress, match learner and teacher observations, and analyze behavioral data.

2. Eligibility and Account Registration

You must be at least 18 years of age to create an account. By registering, you represent that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3. Learner Accounts

Learner accounts are created and managed by authorized Users (teachers, therapists, or administrators) within an organization. Learners may be minors. By creating learner accounts, you represent that you have obtained all necessary consents from parents, guardians, or authorized parties as required by applicable law, including but not limited to the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA).

4. Licenses and Payment

Access to certain features of the Service requires the purchase of licenses. Each license is valid for 12 months from the date it is assigned to a learner. License fees are non-refundable except as required by law. Pricing is subject to change with reasonable notice. Payment is processed securely through Stripe, Inc. We do not store your full credit card information on our servers.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Attempt to gain unauthorized access to the Service, other accounts, or computer systems;
  • Upload or transmit viruses, malware, or any other harmful code;
  • Interfere with or disrupt the Service or servers connected to the Service;
  • Reverse-engineer, decompile, or disassemble any part of the Service;
  • Use the Service to collect or harvest personal information of others without authorization;
  • Reproduce, duplicate, sell, or resell any part of the Service without express written permission.

6. Intellectual Property

The Service, including its design, features, content, and the Self & Match System methodology, is protected by copyright, trademark, and other intellectual property laws. The Self & Match name, logo, and related marks are trademarks of their respective owners. You may not use any trademarks without prior written consent. Your use of the Service does not grant you any ownership rights in the Service or its content.

7. Data Ownership

You retain ownership of the data you input into the Service ("Your Data"), including learner information, form responses, and organizational data. We do not claim ownership over Your Data. We use Your Data solely to provide and improve the Service as described in our Privacy Policy. Upon termination of your account, you may request export of Your Data for a period of 30 days.

8. Service Availability and Modifications

We strive to maintain the availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATA MAKES THE DIFFERENCE, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Data Makes the Difference, LLC and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion with reasonable notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive any right to participate in a class action lawsuit.

14. HIPAA Compliance

The Service is designed to be compliant with the Health Insurance Portability and Accountability Act (HIPAA) where applicable. We implement administrative, physical, and technical safeguards to protect health-related information.
